The Bay of Plenty Marine Oil Spill Contingency Plan outlines how Regional Council responds to Tier 2 oil spill incidents in coastal waters, with help from key partners and people, to help minimise environmental and cultural harm.
An oil spill response is classified as a ‘Tier 2’ when the spill exceeds the clean-up capability of the person responsible for spilling the oil, or where the person responsible for spilling the oil cannot be identified.
If the event exceeds the council's ability to adequately respond to the spill, it becomes a Tier 3 and Maritime New Zealand becomes the lead agency.
This primarily operational plan is reviewed every three years to
ensure it remains fit for purpose, and the updated plan needs to be approved by
Maritime New Zealand.
As part of the current review, we have streamlined
sections of the plan. However, we want to confirm with key stakeholders, iwi,
and hapū representatives that the sensitive sites identified for their
environmental, cultural, or economic significance are accurately recorded. This
will help ensure their protection is prioritised in the event of a spill.
The key aim of New Zealand’s marine spill and pollution response is to minimise damage and to ensure that any affected areas recover as quickly as possible. In line with international practice, New Zealand has a three-tiered approach to manage marine oil spill preparation and response. These Tiers are provided for in the Maritime Transport Act 1994 and each tier can be escalated, depending on the scale of the event.
Tier 1 oil spills - the spiller is responsible
Tier 2 oil spills - Regional Council is the lead agency
Tier 3 oil spills - Maritime New Zealand is the lead agency
In Tauranga Harbour we proactively work with industry to develop detailed plans to protect the harbour should a spill occur (Tier 1). This includes providing best practice advice and auditing high risk and large-scale activities that potentially have a significant pollution risk for the harbour.
All regional councils must have a regional (Tier 2) oil spill contingency plan and ensure it is regularly tested. Regional councils are also required to maintain a trained response team, including wildlife response specialists.
Bay of Plenty Regional Council responds when the spill exceeds the clean-up capability of the person responsible for spilling the oil, or where the person responsible for spilling the oil cannot be identified.
The primary objective of a Tier 2 contingency plan is to safely prevent further pollution from the marine oil spill. The plan itself is largely operational in nature to enable any oil spill to be dealt with quickly and efficiently.
In the event of a Tier 3 response in the Bay of Plenty, this Plan will provide Maritime NZ with specific regional information to assist in responding effectively to the spill.
The current Bay of Plenty Marine Oil Spill Contingency Plan (Tier 2 Plan) was made effective 12 July 2021 and is now due for review.
What’s changing?
The updated Plan is divided into 10 sections, and you can view these under ‘Documents’ on the right-hand side of this page.
The updated Plan is largely the same, however we have reviewed and streamlined the operational sections (for example the Equipment and Resources section). We are now seeking feedback on the Sensitive Areas section.
The maps contained within Annex 04 – Sensitive Areas were recently updated. Due to the number of maps and size of the file these maps have been separated out into smaller geographical areas to make them easier to navigate. You can access these smaller files in the ‘Have your say’ tab.

Can you remain anonymous or withhold personal information?
Yes. You can access and participate in select Participate BOPRC engagements anonymously, without disclosing any personal information. Some identified projects may require you to register and establish an account in order to participate. As stated above, users may choose to adopt a pseudonym for these projects.

Participate BOPRC is equipped with analytics services which assist us to collect and interpret information.The information collected may include your IP address, web browser, mobile network information, pages viewed, time spent on pages or in apps, links clicked and conversion information.This information is aggregated and all users are anonymous and not personally identifiable.
This statistical information will be viewable by website administrators and Social Pinpoint. This information may be used by us to analyse and track data, determine the popularity of certain content, and better understand online activity.

Sharing of your personal information

When you sign up to and use Participate BOPRC, some of the information you provide will be publicly available.
Information that is available to the public is limited to your username and any comments you leave under that username in the forums or other feedback tools published to Participate BOPRC. As above, you can use an anonymous user name if you do not want your full name attached to your comments.
Feedback (including overall results of polls and surveys, and in some instances, quotes from forums and surveys with the username referenced) may be published in publicly available reports at the end of the consultation period.
You may use Participate BOPRC to make submissions to BOPRC pursuant to the Local Government Act 2002 (for example, submissions on annual plans or long term plans).By taking part in the public submission process, submitters agree to any personal information (including names and contact details) in their submission being made available to the public and published on our website, and for the information collected to be held in accordance with BOPRC’s general Privacy Statement available at www.boprc.govt.nz
Application Programming Interface
We provide an application programming interface (‘API’) to enable third party applications to interface with Participate BOPRC.
If you choose to allow the application to connect to your Facebook account to create an account for Participate BOPRC, then that application will be able to access information that you can see when you are logged in to your Facebook account. You should only allow applications you trust to access your account. If you set up your Participate BOPRC account using an API with a third party social media platform, you consent to us obtaining and using your information from such platform.
BOPRC may use third party applications to analyse the comments, votes, posts and selections you contribute to better understand the themes and trends in the feedback received. This information will be provided anonymously i.e. personal details such as responses to name and email address categories are not provided to the third party application. The analysis will assist with reporting themes and trends back to participants, BOPRC staff and councillors from the aggregated responses.
Storage of personal information
Information collected through Participate BOPRC will be held by Social Pinpoint in accordance with its privacy policy. Social Pinpoint is an offshore service provider based on Australia so personal information collected will be stored in their server located in Sydney, Australia. The information will also be downloaded on BOPRC servers with privacy protections in place. We comply with the requirements of the Privacy Act in relation to the transfer of personal information offshore.
Access and Correction
If you would like to access, update, correct, or delete the personal information that the BOPRC is holding about you, you are welcome to make these requests by emailing BOPRC at privacy@boprc.govt.nz.
We will provide you with access to your personal information unless we are required or authorised to refuse such access by law.
You may also request a change or correction of personal information that we hold about you. When you are a registered user you will have the ability to correct your personal information at your discretion through the ‘edit profile’ function.
